How Fast Can I Get My Loved One Out of Jail After a DWI?

Stephen H.: Hello, I’m Stephen Hamilton, a board certified criminal defense attorney practicing in Lubbock, Texas. Today’s video tip dealing with DWIs is, how fast can I get my loved one out of jail? That’s usually a telephone call that I get on a weekly basis. If someone you love has been arrested in Lubbock, Texas, then the arresting agency is going to take them eventually to the Lubbock County Jail. And what’s going to happen is, they’re going to be booked in to jail and after that point in time they’re going to see a magistrate.

Stephen H.: So there are really two things that we’re looking for before we can get the person out of jail. First, they’ve got to be booked in. Now, if you have a son or daughter and you’re out of Dallas or you’re in Houston, the best thing that you can do to find out when they’re booked in is just to Google Lubbock County Sheriff and look at the active jail list. Once you see your loved one’s name on the active jail list, you know they’re booked in. And at that point in time they’re waiting to see the magistrate. In Lubbock they have to see the magistrate for the bond to be set, and so they can either wait for the magistrate to be set or we can try to get to the magistrate and sort of move them to the head of the line. Once the bond is set, then they can bond out either using a bail bondsman or a 10% bond, or if you pay cash bond.
