Do I Have to Give a Blood Test?

Stephen H.: Hello, my name is Stephen Hamilton. I’m a board certified criminal defense attorney. I practice in Lubbock, Texas and the surrounding areas, and today’s video clip deals with blood testing.

Stephen H.: If the police officer, after you are arrested for a DWI, took a blood sample from you, whether that was voluntarily, in other words, you agreed to give the sample or they had a court order or what we call a mandatory test, that sample is going to be tested at the DPS Crime Lab, typically in Lubbock, Texas for this area, if it’s dealing with alcohol.

Stephen H.: Now, there are some real specific issues with blood testing, the chemicals that are used, the testing components that are used, but I think what’s important initially as we visit is if that blood sample comes back above a .08 or above the legal limit, then you’re going to receive a letter, or you should receive a letter from the Department of Public Safety telling you that you have 20 days to request a hearing on your driver’s license, and that’s absolutely critical in the case. It’s our first opportunity to start contesting or examining the blood test issues.
