Stephen H.: Hello, my name is Stephen Hamilton, and I’m a board certified criminal defense attorney in Lubbock, Texas. I practice in Lubbock and the surrounding areas. And today’s DWI video clip is what to not do after you’ve been arrested for a DWI.
Stephen H.: People ask me all the time, what do I do now that I’ve been arrested? One of the things you want to know is there are several things you don’t want to do when you’ve been arrested for a DWI. Believe it or not, two or three times a year I will get a client who I’m representing on a first DWI, and before we’ve even resolved that case they’re arrested on another DWI. So if you have a DWI pending, the last thing you want to do is be drinking and driving after the first arrest.
Stephen H.: Second, if your driver’s license is suspended, you do not want to drive on a suspended driver’s license. We can get you an occupational license or an essential-needs license most of the time, but you don’t want to be driving on a suspended driver’s license.
Stephen H.: Third, please do not post anything about your DWI on your Facebook account. I know that sounds sort of silly, but there are cases that people will post their drinking patterns and behavior on Facebook. And the district attorney’s office is going to search your Facebook page to look for pictures that you’re at the bar or saying that you’ve had so much to drink that you don’t remember anything. So if you have been arrested for DWI, don’t post anything on Facebook about it. Don’t get another DWI, and don’t drive on a suspended license.
