DWI Laws in Dallas

In Dallas, according to Texas Statutes § 49.04, it is unlawful to drive a motor vehicle while intoxicated. A person is considered legally intoxicated in one of two ways, according to Section 49.01. First, they are considered to be under the influence if their mental and physical faculties are compromised due to the use of alcohol, drugs, or a combination of both. Second, police may deem a person intoxicated if they have a blood alcohol concentration (BAC) of 0.08 or greater.

Typically, the evidence the state uses to prove intoxication involves police testimony regarding the facts leading up to the traffic stop, a field sobriety test administered at the time of a traffic stop, and/or the results of a breath test.

Convictions for a DWI may require a jail sentence in Dallas, but the length of incarceration depends upon the facts of the case. For a first DWI without any aggravating factors, there can be a minimum three-day jail term. Having an open container in the vehicle can increase this to a six-day jail term. Individuals who have prior DWI convictions or who registered a BAC of 0.15 or greater may face far more serious punishments. These can involve a lengthier jail term.

A conviction for DWI can also carry a fine ranging from $2,000 to $10,000 and a license suspension of between 90 days to two years, depending upon the severity of the case.
